Subdivision Road Dispute:West Bath, Maine The City of Bath brought our client into a Rule 80K lawsuit because the original developer failed to obtain an emergency road and a mooring road access over our client's land located on Merrymeeting Bay. Interestingly, when the Bath Planning Board approved the subdivision in 1987, the Planning Board signed one plan that showed an emergency road access over our client's land and a second plan that did not. Fortunately for our client, the plan that did not show the emergency access road was the one that was recorded. After a hearing in November, the developer agreed to pay our client for a limited access and our client will be released from the Rule 80k suit. |
